Terms of Use

1. Terminology

For the purpose of this Agreement, the following terms apply: 

Client: The term ‘Client,’ referred to as ‘you’ or ‘your’ refers to the individual or entity who is paying for the service provided by me. 

Instructor: The term ‘Instructor’ refers to Melissa Dodo Garba, who will be providing tutoring/ESL services to the student. 

Student: The term ‘Student’ refers to the individual who is receiving the services provided by the Instructor. The student is the recipient of the academic support, guidance and/or English courses offered by the Instructor under the faciliated arrangement and paid for by the Client. 

Site: This term refers to the website tutorlemonde.com 

2. General Terms

Please read these Terms and Conditions carefully before using my services. These terms govern your use and access of the Tutor Le Monde website and services provided by the Instructor. By accessing, registering via my Site and use of my services, you acknowledge that you have read, understood and agree to these Terms and Conditions, and you are of legal age to enter into a binding contract. If you are accepting these Terms and Conditions of behalf of a minor, you acknowledge that you are the legal guardian or parent of that minor and accept full responsibility for their compliance with these Terms. 

I reserve the right, at my discretion, to modify, add or remove portions of these terms at any time, and each such change shall be effective immediately upon posting. Your continued use of this Site following the posting of changes to these terms, will imply acceptance of those changes. Please check these terms periodically for changes. 

If any provision of the Terms is held invalid by any law or regulation by any government, or by any court or arbitrator, the parties agree that such provision will be replaced with a new provision that accomplishes the original business purpose. 

3. Fees & Payment

  • Payment is made through the TutorBird management system via Paypal integration or debit/credit card. 
  • The initial (first) lesson is free, and will not be billed. All sessions after your trial session will be billed on that months invoice. 
  • Clients will receive a monthly invoice at the agreed rate for all sessions booked within that month. For example, on  September 1st, you will receive an invoice for August 1st – August 31st sessions. 
  • Invoices are sent on the 1st of each month, and due no later than 7 days after its send date, unless an alternative due date has been previously arranged. 
  • Payment request (invoices) will always come through the TutorBird management system. 
  • I reserve the right to impose a ‘late payment fee’ of 10 on a months invoice, if payment is received 3 or more days after the due date.  
  • I reserve the right to change my pricing and payment terms at any time, with notice provided to the Client. 

4. Scheduling

  • When the Client makes their initial inquiry through my Site, a specific weekly time slot will be assigned to the sessions. 
  • Additional sessions may be added on a direct request to the Instructor or via their TutorBird portal. 
  • Arranged sessions will always be visible on the Clients calendar within their portal.
  • The Instructor commits to being available for the full duration of the agreed upon time slot(s).  
  • The Instructor has placed a 12-hour advanced booking window in order to ensure the quality of each lesson. If you need an emergency, last-minute session, please contact the Instructor directly.

5. Punctuality

  • If a Student arrives late to their scheduled session, the missed time will not be made up afterward, and the lesson will end at the originally scheduled time. 
  • If a Student does not show up to an agreed session, a reminder email or message will be sent to the Client. The session will be charged in full. 
  • It is the Client’s responsibility to check the calendar of scheduled sessions and ensure that the Student attends on time. 
  • Should the Instructor be late for a scheduled lesson, if possible, the session will be extended to make-up for lost time. If extending the current session is not possible, the missed time will be added to another sessions agreed upon by both parties. 
  • Should the Instructor have to cancel a session less than 24 hours before, the Client will be charged as usual, and a lesson credit will be received. 

6. Instructors Obligation For No Shows

The Instructor will keep the online Zoom meeting open for the first half of the missed lesson. If no contact is made by the Client by that time, the meeting will be closed, and the session will be charged at the standard agreed rate. 

7. Cancellation Policy

If a Client wishes to cancel a session, they must do so either through the TutorBird portal or direct notification to the Instructor at a minimum of 24 hours prior to the session start time. Failure to provide notice will result in the session being charged at the standard agreed rate. 

8. Repeated Late Cancellations or No-Shows

I reserve the right to give away your time slot if there are 3 repeated cancellations or no-shows. 

9. Instructor Cancellations

  • The Instructor agrees to provide instruction for the full contractual period with the agreed upon time slot. 
  • If the Instructor has to cancel a session, I will offer to rearrange the lesson to a mutually determined day and time. 
  • If it is not possible to rearrange, then credit will roll over into the following month’s invoice. 
  • The Instructor must and where possible, give 24 hours advanced notice when cancelling a scheduled session.

10. Client Obligations

  • The Client is responsible for ensuring that the Student is ready with the appropriate materials for each sessions, including a notebook, pen/pencil and calculator (if needed). 
  • The Client is responsible for making sure the Student is logged into online sessions at least 5 minutes before the scheduled start time, so they are ready to go. 
  • The Client should provide a quiet environment away from distractions. 
  • Students are expected to have their cameras on for the duration of our session. 
  • If there are any problems during a session, please report to the Instructor immediately. 
  • Clients may request specific topics or objectives for a session by giving a minimum of 24 hours advanced notice. This ensures that the Instructor is properly prepared. 
  • For students under 18, an adult must be present in the house for the duration of the session for the purpose of safeguarding the Student. 
  • Clients must strictly ensure that students are fully dressed during all lessons. There is no exception to this condition. In the unlikely event that this occurs, the Student’s camera will be promptly turned off and the Instructor will make immediate communication to the parent/guardian. 
  • Clients may request for weekly homework to be supplied. Homework will be reviewed by the Instructor during the following session and verbal feedback given to the Student. 

11. Instructor Obligations

  • The Instructor agrees that delivery of sessions will be done in a professional manner. 
  • The Instructor is responsible for planning and delivering lessons which are tailored to the individual needs of the Student. 
  • The Instructor will deliver online lessons through Zoom at mutually agreed upon times. 
  • The Instructor is expected to have their camera and microphone on for the duration of the lesson. 
  • The Instructor reserves the right to report behavioral problems during lessons to the Client, and may refuse to instruct Students with persistent unacceptable behavior. 
  • The Instructor must report any concerns about Student safety and wellbeing to the Client and/or the necessary authoritative body. 
  • The Instructor will provide feedback after each session either verbal on Zoom or written through the TutorBird portal. 

12. Additional Services

  • Paid ‘Parent Meetings’ or ‘Student Meetings’ for adult learners with the Instructor can be arranged at mutually convenient times. 
  • Extensive homework and home-learning packets can be requested at an additional cost. 

13. Termination of Services

  • Lessons will be continued until a mutually agreed termination date. 
  • The Instructor reserves the right to terminate or suspend your access to the service at their discretion if it is believed you have violated these Terms or for any other reason. 
  • You may terminate services by providing at least 1 week’s written notice. 
  • Refunds will not be distributed for any completed service. 

14. GDPR Statement

  • Personal data is securely stored and used only for legal business related purposes. 
  • Personal information will not be shared with third parties without explicit consent, except when legally required to do so. 
  • Clients have the right to request the deletion of their information, however performance of services may cease upon deletion. 

15. Privacy

By using this service, you consent to the practices described in the Privacy Policy 

16. Limitation of Liability

  • To the extent permitted by law, Melissa Dodo Garba shall not be held liable for any direct, indirect, incidental, consequential or special damages arising from or in any way related to your use of the services, even if I have been advised of the possibility of such damages. 
  •  To the extent permitted by law, Melissa Dodo Garba accepts no liability for direct or indirect losses, damages or errors in learning materials.
