Privacy Policy

I respect your privacy and I am committed to protecting your personal data. This privacy policy will inform you as to how I look after your personal data through use of my services, including any data you may provide through this form when you register. This application process is not intended for submission by children. This privacy policy supplements other policies and is not intended to override them. 

1. How is Your Personal Data Collected?

You may provide your identity, contact and financial data by filling in forms or by corresponding with me via TutorBird, phone, WhatsApp, email or otherwise.

2. What Data Do I Collect?

Personal data or information, is defined as any information about an individual from which that person can be identified and is protected under French Law no. 78-87 of 6 January 1978, law no. 2004-801 of 6 August 2004, article L. 226 -13 of the Criminal Code and the European Directive of 24 October 1995. I may collect, use and store different kinds of personal data which is grouped as follows: 

Identity Data = Includes first and last name, age and grade level of students, and gender.  

Contact Data = Includes billing address, email address, telephone numbers and teachers emails (when necessary). 

Transactional data = Includes details about payments from you for the service. 

Profile data = Includes purchases made by you, feedback, survey responses and parent preferences. 

Aggregate Data = Statistical or demographic data. Aggregate data may be derived from your personal data, but legally, is not considered personal data as this data does not directly or indirectly reveal your identity. For example, I may aggregate the duration of time you use my services or the percentage of students who increased their GPA using my services.

** Where I need to collect personal data by law, or under the terms of a contract I have with you, and you fail to provide that data when requested, I may not be able to perform the service as requested. In this case, I may have to cancel a service you have requested, but I will notify you if this is the case at that time.   

3. How Do I Use Your Personal Data?

I will only use your personal data when the law allows it. Most commonly, I will use your personal data in the following circumstances: 

Service delivery: 

Data used = identity, contact and transactional data

  • Scheduling and conducting sessions
  • Tracking academic progress and outcomes
  • Processing payments and managing accounts
  • Providing customer support
 

Business Operations: 

Data used = identity, transactional and aggregate data 

  • Quality assurance and service improvement
  • Business reporting and analytics
  • Legal compliance and risk management

Marketing Communications

Data used = identity, contact and aggregate data 

  • Sending service updates and educational content
  • Market research and customer feedback
  • Website personalization and improvement
** If I need to use your personal data for an unrelated purpose, you will receive prior notification and explanation of the legal basis which allows me to do so. 
 

4. Disclosures of Your Personal Data

Your personal data will only be shared by internal parties (aggregate data is not included and can be distributed at will of the owner). 

5. Data Security

I have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, altered, disclosed or access in an unauthorized way. In addition, I limit access to your personal data to individuals who have a business need to know (auditors, government employees, etc)

I have put into place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where I am legally required to do so. 

6. Special Protection For Children

As an educational service provider, I take special care with children’s data: 

  • Parental consent required for children under 18
  • Enhanced safeguarding procedures
  • Careful monitoring of online interactions 
  • Strict data minimization for young learners
  • Regular safeguarding reviews and updates

7. Data Retention

I will only retain your personal data for as long as necessary to fulfill the purposes I’ve collected it for. This includes satisfying any legal, accounting or reporting requirements. 

To determine the appropriate retention period of your personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purpose for which I process your personal data and whether I can archive those purpose through other means and the applicable legal requirement. 

By law, I am required to keep basic information about my customers (contact, identity, financial and transactional data) for 5 years after they cease being a customer for tax and regulatory purposes.

Under French law, you have complete rights over your personal information. You have the following rights relating to your personal data: 

Access Rights 

    • Right of Access: You have the right to request copies of your personal data.
    • Right to Rectification: You have the right to correct inaccurate or incomplete data. 
    • Right to Erasure: You have the right to request deletion of your data. 
    • Right to Restrict Processing: You have the right to limit how I use your data. 
    • Right to Data Portability: You have the right to transfer your data to another provider (a new tutor or English teacher) 
    • Right to Object: You have the right to stop the processing of your data for marketing or legitimate interests
